3. Payment Terms

• One-Time Services: Payment must be made in full before work begins unless otherwise agreed.
• Recurring Contracts: Payments are billed on a recurring schedule as outlined in your contract.
• Late Payments: Payments not received by the due date may incur a late fee or interest as specified in your agreement.

4. Refund and Cancellation Policy

• Refunds: Refunds are not guaranteed and will be evaluated on a case-by-case basis, depending on the project stage and work completed.
• Cancellations: Clients may cancel services by providing written notice as specified in their contract. Refunds or additional charges for cancellations will depend on the terms of the individual agreement.

5. Client Responsibilities

• Timely Communication: Clients must provide necessary assets, approvals, and feedback promptly.
• Third-Party Access: Clients must provide access to relevant accounts or platforms (e.g., social media accounts, web hosting) to facilitate service delivery. Buttermilk Toast will take reasonable precautions to protect client accounts but is not responsible for security breaches caused by third-party platforms.

6. Intellectual Property

• Ownership: All final deliverables will become the property of the client upon full payment unless otherwise agreed.
• Portfolio Use: Buttermilk Toast reserves the right to use completed projects for marketing and portfolio purposes unless expressly prohibited by the client in writing.

7. Confidentiality

Both parties agree to maintain the confidentiality of proprietary information shared during the project. Buttermilk Toast will not disclose client information to third parties without prior consent, except as required to perform services or by law.

8. Limitation of Liability

• Buttermilk Toast is not liable for delays or service disruptions caused by third-party platforms or external factors beyond our control.
• Our total liability under these Terms is limited to the fees paid for the service.

9. Dispute Resolution

• Governing Law: These Terms shall be governed by the laws of the State of Utah.
• Resolution Process: Disputes will first be addressed through good-faith negotiations. If unresolved, disputes will be settled through mediation or arbitration in Utah, unless otherwise specified.
